Dear To Whom:
I have read your open letter and find it interesting that you fail to mention that Tycho,Steven Kerr plays publishing royalties for all the song that he sequences. These fees are not inexpensive and must be payed to run a ligitimate bussines.
I only hope that if you use these sequences at a paying gig, that the club owner pays you and not the first stranger who walks up to the cast register at the end of the night. You see you worked you should get payed. And I am sure you pay taxes on all the money you make in cash. Being a person who appears to want to support freedoms I hope you pay your far share to the Government who has to protect business people from pirates and hackers and THEIVES. You can always make your own sequences without any penalty.

No, Kern pays royalties in order to set himself up to sue. He's found a gimick and he's making use of it in the attempt to get rich.
And learn to spell.

Take your lame excuse of "music was meant to be shared" over to the local grocery store and see if they will share some food with you. Or, try that with your landlord and see if he or she will share your apartment rent for a few months so you can go out and share your music.
If you will look around the planet, the societies that tried the "share the wealth" plan have failed.
Capitalism is not a perfect system but, if you are just a little aware, the US is the most notable capitalist society and the US is where most of the immigrants of thw world are heading.

First of all you must learn something about the royaly fee that Trycho was paying. The fee did not make him the owner of the song, it just paid a fee to the publisher or writer of the song for use of the meloody. Trycho is sueing people who use Trycho midi sequences. Some people have the misconception that creating a good midi sequence is easy. I have been doing it for about 17 years now and I can tell you that making a bad sequence is easy, making a good one is very difficult. Trycho made good sequences and sold them or use by other musicians. Good quaility sequences take many hours sometimes days of work and require the skills of both a good musician and a person with very good computer skills. What the cost of a record has to do with this dicussion is irrelevant. If you paint a picture of a building and an advertiser uses your painting in an advertisement. you as the artist should be paid for your work. If people are using Trycho sequences without paying Trycho for it's use, that's wrong.

I should have looked at the list of people being sued before writing my earlier comment. Some of the names on this list like Phil Wood are people who sell midi sequences. If Phil Woods is selling Trycho sequences Kern has every right to sue for the misuse and resale of his work. Phil Woods has his own buisness (Midi Hits) and is being sued for selling Trycho's sequences. Many on the list are midi sites that sell midi sequences. That is what these lawsuits are all about. Re-selling Kern's work without compensation. |

Interesting stuff about Steve Kern… I just logged on today to try and buy a particular tune, and found the Trycho site closed. I've known Steve since 1992. I ran into an issue with one tune that I really wanted him to sequence, but it rights were hung up in a copyright dispute among the writers. I had heard the song several times on TV from a video produced by the recording artist who did the popular version of that song back in 1993. The artist never put it on one of his albums. Steve refused to produce a sequence of that song because he couldn't get clearance from Harry Fox Music, the licensing authority. Steven wouldn't break the law. I admired that.
In my opinion he's a genius at MIDI sequencing. His products are absolutely some of the best available when it comes to the purity and simplicity of the finished product. And I've noticed a number of his MIDIs available on other sites for both pay and for "free". That's wrong, and the law supports Steve Kern. A song can be copyrighted and a MIDI sequence of a copyrighted song can also be copyrighted. They are both the intellectual property of their respective creators.
I like Steve. I've spoken with him many times over the years and I've been a good customer. I've probably purchased over $3,000 of his work. I guess it irks me that other people think that his work should be free. I don't work for free, do you? Steve is one of the best MIDI producers out there and I know he pays royalties to Harry Fox that are due the writers and artists. He is simply exercising his legal right to protect his property. I've purchased some from Phil Woods and Tran Whitley, too. I think I get great stuff and I pay for it. I guess they're all a**holes too, because they charge for their sequences…?
You sound like my kind of person. I'd like to hire you and your band to do a 4 hour gig three nights a week at my club. For free, of course. Music should be free, right? For that matter, everything should be free…. You probably don't have any intellectual property, so you should share your house, your wallet, your music gear and your car … Give them to the Salvation Army… please!

No body is saying music is free. For the love of god when the NRRAA went out suing people for downloading mp3's they found people with thousands of mp3 collected and sued them for tens of thousands.
On this side of the field, Steven Kern is making midi sequences and using people $100,000 per song that isn't his originally. I'm sure he pays rights to someone. Ask radio head about a record label.
Steve might be a good sequencer, ill tone down the entry because as time goes by, the harsh words stay harsh and don't forgive and forget.
Know this suing people about midis when most people don't even know what they are is ridiculous and sure as shit isn't worth $100,000 each. |

That bastard sued me over 7 years ago, and I was forced to close down my popular free midi site. I had to settle out of court and pay him several thousand dollars for no god damn reason. What an asshole. I hope he rots and goes to hell! |

If you were "forced" to settle out of court, then your attorney must have recognized you broke the law. Funny how that happens. Steve Kerrs has always run a LEGAL business, and I respect his work and talents. His sequences have allowed me to earn a nice income performing without wasting hours upon hours sitting in front of my PC. It sounds like a lot of pussys complaining, why didn't you come up with his business model? Too busy crying I guess. Good luck Steve, hope your back online soon. |

Amen to the above comment. I use Steve Kern's sequences and I have paid him for that use. As a musician I want to be paid for my work and in tiurn I expect to pay others for theirs.I grew up in 60's but that hippy dippy "music should be free" is bullshit. I have given thousands of hours of my life to creating and performing. While I enjoy it, I also do it as a buisness and expect to be compensated.Stop making Steve Kern seem like a creep.He is a legit buisness person who thankfully pays royalties to the writters of songs he uses to create his sequences (something few people do). In return he wants to be paid for the many, many hours it took him to create his sequences. Admit when you are wrong and move on. |

It seems pointless to educate anyone who doesn't understand what midi can do. How many of your favorite performers have their drummer wearing a headset when they perform live? It's not so he can hear better. Chances are he is listening to a midi sync track. The midi track can sync your lights and effects as well as trigger music that I have played and recorded in midi form on my computer as an added sound to my live playing. Midi can also trigger all types of echo, reverb, chorus and other effects on your sound system. I use midi to enhance my performance of both original and other peoples songs. My partner and I are quite popular in our area and have used our set up to open shows for several major artists. I'm out there making music and performing every week because I love doing it.
I may be a "wanker" in your eyes, but I suspect you are a "sit a home do nothing but critique others" type of person anyway. You comment on subjects you have no knowledge of and will never admit to being wrong. So who's the "wanker"? |

Jesus, are you Fucking serious???!!! Steven Kern is largely responsible for my two cars, my health insurance, my house, my awesome and successful career as a professional musician... ...why? Because he makes (made?) the finest sequences with the greatest, licensed, legal, business ethics in the 15 years I've worked as a guitar, vocal sequenced solo. I too was unable to get Steve to sequence songs he couldn't clear through Harry Fox. And YOU are unhappy he tried to cover his ass and go after people selling sequences HE spent hours making perfect on their own websites?? Who's the Asshole here..YES, it's you! Perhaps this answers the question why, after all these years of being the best in the business, and fast, and friendly...he's gone. No website, no numbers. I have dealt with Steve for several years and used his sequences as backup for my gig as a solo musician. Steve has always been helpful and pleasant to deal with. I had asked permission to use some of his sequences on cds that I sold. He gave me the info I needed to secure the licensing and his fee for the use of his files was 10% of what others wanted to charge. So I don't know what the complaint is about him but I have never dealt with a more honest, professional and helpful individual. Also the more songs purchased the lower the price ($2) and $9.99 is pretty standard pricing. |

COME ON MAN GET REAL, Midi is business he is just the first to harness that business. I have been using Trycos midi songs for years and have made a good living doing so. Most of the midi stuff you can get on line for free is junk and the people that play that junk live give the one and two man shows a bad name. ie. sounding likecrap. I have found lots of midi tunes that band directors have put together and the drums always sound like a band director did them.While the rest of their music is ok, the drums are usually pathetic.I think if you were making as much money as some of us have using Steven Kerns midi tunes you would be happy that there are professional companies out there that you can depend on the quality being consistently good.. |

1: For those who need pro MIDI Files and miss Steve's songs, I have found a great site called HitTrax. Go www.hittrax.com.au or www.midi.com.au Best MIDI site on the web and customer service 2nd to none in any country.
2: Steve Kern got tired of dealing with website owners who were denying him his rightful income. At the end of the day, piracy is theft. OK? We all know it, so let's stop being in denial. 3: How many people complaining here have invested tens of thousands of dollars and counteless unpaid hours in a business like Steve and other individuals, only to have ignorant persons stealing their products? Think about it. You pour a ton of money, thousands of hours to get ahead in life and everyone thinks they have the right to use your product for free... Doesn't add up - right? 4: To all those whinging and whining persons carrying on about free file sharing and music should be free, blah blah blah .... do yourself and us a favor - go educate yourself. Better still, invest the 40 to 80k it takes to setup this type of business, pay for the ongoing costs, licensing, programmer fees etc, while in the meantime, you are putting your children through school, paying a house off, running the family car, buying groceries, blah blah blah, then come back here in 12 months and tell the rest of us that music should be free. 5: And for those persons complaining about the price of a MIDI File - try programming one. Go out and buy all the gear, programs (buy them, don't download them), get your music degree or at least know how to play almost every known instrument, learn to use a sequencer, edit, mix then include your business costs.
Should be about 3 to 5 years and around $40k to $80k by now. Then, set up your online store (another $5k+) and wait until you build up enough clientel to start making a living. Of course, you will have to fend off your file sharing mates to stay in buiness. Just pay the money and be grateful somebody has done all the hard work for you.
